On June 13, 2017, the FDA announced it will extend the compliance date for the Nutrition Facts Label final rules.

In May 2016, the U.S. FDA finalized the Nutrition Facts and Supplement Facts Label and Serving Size final rules and set the compliance date for July 26, 2018, with an additional year to comply for manufacturers with annual food sales of less than $10 million.

If you are a qualified small company, Register-FDA can submit a label exemption on your behalf for $195.


Register-FDA, will submit your exemption notices to the Office of Nutritional Products, Labeling, and Dietary Supplements (ONPLDS) which means your company will no longer need to submit paper forms to the FDA. And, it will be easier to renew your exemptions each year.

Firms that file for a Small Business Nutrition Labeling Exemption must meet the following requirements:

  1. You must employ less than an average of 100 full-time equivalent employees.
  2. You must sell less than 100,000 units of that product in the United States in a 12- month period.

If any nutrient content claim (e.g., “sugar free”), health claim, or other nutrition information is provided on the label, or in labeling or advertising, the Small Business Nutrition Labeling Exemption is not applicable for this product.

The submission of a Small Business Nutrition Labeling Exemption Notice only pertain to nutrition labeling, and has no effect on other mandatory information (e.g., statement of identity, net quantity of contents, ingredient statement, allergy information, and name and address of manufacturer, packer or distributor).
